The driver of a crash last fall that pushed a car into the path of a truck has been charged with Misdemeanor Motor Vehicle homicide.
44-year-old Keith L. Turner of Murray was declared deceased at the scene of a three-vehicle collision about 1:30pm on September 4th of last year. Turner’s vehicle was struck from behind and pushed across the centerline into the path of a rock truck with pup, said law enforcement.
The driver of the car that struck Turner’s vehicle from the rear, 23-year-old Chase Lautenbach of Omaha.
Cass county attorney Nathan Cox tells WOWT6 news that careless driving led to the charge. He says Lautenbach should have slowed for the turning car. Cox says it took this long because he wanted to gather the information from an accident recontruction team. Cox says speed over the speed limit at texting are not factors.
An arrest warrant has been issued for Lautenbach.
A civil suit is already in the courts.
The suit seeks general damages, judgment for conscious pain and suffering sustained by Keith Turner, and special damages.
The suit, which asks for a jury trial, claims Lautenbach failed to maintain a proper lookout, operated his vehicle at speed greater than was reasonable and prudent for the conditions, and failed to maintain reasonable control of his vehicle.
