Most Bars in Cass county still must abide by 1am closing time.
The issue was revisited about a month ago but a tie vote put the matter forward to the next meeting with a full panel of Cass County Commissioners. A resolution was on this week’s agenda.
In 2010 the state gave cities and counties the authority to decide if the local establishments in their respective jurisdictions can stay open until 2am. Bar owners always have the option to close their establishments earlier if they so desire.
The latest 2am closing request by Robin Garner, owner of Tiki Time at Beaver Lake, was before the board in October. A motion to allow the 2am closing failed then on a 2 to 2 vote. Commissioners Duane Murdoch and Dan Henry voted for it; Commissioners John Warsing and Janet McCartney voted against it. District 3 Commissioner Jim Peterson was not at the meeting. But following that vote, it was the general consensus of the four board members to consider the 2am closing again at a future meeting with all five commissioners present and after more research is done. At this week’s meeting, Peterson made the motion to approve giving bar owners the option to close at 2am. It died for lack of a second.
Murdoch said this week he didn’t see anything “beneficial” in allowing the 2am closing time. Warsing said he was most concerned about individuals having “those last two drinks” and then driving.
