Bond is $100,000 in torristic threat's case but this is different than most. The pregnant 35-year-old defendant has been in Cass County Jail since May 19th. Her due date is about three weeks away.
The Cassgram reports Tricia Kerns of Council Bluffs is charged with three Class IV Felony counts. The arrest warrant affidavit says a sheriff’s department investigation alleges she sent text messages to her ex-boyfriend that threatened him, his wife and their child. The family now resides at Beaver Lake.
The case was bound over from Cass County Court and the county judge kept the bond at $100,000. Now in district court, Judge Randall Rehmeier did not reduce bond at a recent hearing. He will take up the bond issue again after he reviews the case and will also hear a plea in abatement motion from Julie Bear of the public defender’s office on July 6th.
Bear contends it cannot be proven the message was sent by Kerns. She says the case went forward on “scanty evidence.” The plea in abatement motion also says there should be only one count of terroristic threats filed, not three.
The affidavit indicates a continuing history of Kerns contacting her old boyfriend. Cass County Deputy County Attorney Steve Sunde said the text message that resulted in the charges “is not an isolated incident” and bond should not be reduced.
Judge Rehmeier received assurance from Sunde that the county was ready for the childbirth situation.
