A west Omaha day care facility has been shut down by the state. Tammy's Tiny Treasures has been ordered closed.
Zachary Boddicker spent three-and-a-half years in Tammy Arndt's care but that changed a couple of weeks ago when the Boddickers found bruises on Zachary's bottom. The four-year-old says Arndt's boyfriend, Richard Jones, spanked him after Zachary wet his pants.
Zachary's father Mike Boddicker says, "So far, he's only had two really bad nightmares that he woke up screaming in the morning, really scared to death."
The state investigated the facility and decided to immediately shut down the day care that Tammy Ardnt was running.
Then Zachary's parents found out that this wasn't the first time that this day care had been ordered closed.
Nebraska Health and Human Services records show the first emergency closure happened in May 2003 after one child bit another. After a hearing, the state placed Arndt on probation. in December 2003, for two years.
Zachary's parents say they were never notified.
Mike Boddicker says, "I would have pulled him out instantly. I wouldn't have taken a chance. He's our only son. No way would I have taken a chance with that."
Another concern arose in February 2004. HHS learned that Richard Jones was believed to be at the day care. The state says convictions of Assault and Battery, DUI, and Disorderly Conduct make that unacceptable. Arndt entered into a new agreement preventing Jones from being present at the day care.
The Boddickers now say that the only place they believe Zachary will be safe is at home
Ruth Boddicker says, "We trusted her with our child, paid her to take care of him and she failed us, and that's really scary."
Both Richard Jones and Tammy Arndt deny that anyone spanked Zachary. They say the bruises came from a trampoline fall. Zachary's doctor disagrees.
Jones has a court appearance in September.
