A 31-year-old Avoca (NE) man will be sentenced June 14th on a Class I Misdemeanor conviction of third degree assault. Joseph Clark had faced a felony assault charge but that was amended to the misdemeanor when he agreed to plead no contest. There is no agreement on sentencing.
Cass County sheriff’s deputies were called to the Roadrunner Bar in Avoca on December 5th for a physical disturbance. Cass County Chief Deputy County Attorney Colin Palm said deputies encountered a number of people and determined there had been a fight between Clark and Dennis Sedlachek of Avoca. The incident climbed to the original felony charge because Clark had used brass knuckles to strike Sedlachek, causing a small laceration to the forehead.
Palm said Sedlachek is aware of the amended charge and had no problem with it.
The sheriff’s department will dispose of the weapon.
