A Cass County Judge follows the attorney's recomendation and gives two years probation and restitution as part of a decision on an assault case.
The Cassgram reports the prosecution and defense jointly made the probation recommendation as part of a plea agreement in the case involving 22-year-old Drew Jones of Nebraska City. Jones originally faced a felony charge of first degree assault but agreed to plead guilty to the Class I Misdemeanor of third degree assault.
Jones struck a 30-year-old Bellevue man in the head with his fist last summer on a boat at Beaver Lake. He thought the man had made advances toward his (Jones’) girlfriend. Cass County Deputy County Attorney Steve Sunde said most witnesses said the victim never saw the punches coming and was rendered helpless after the first punch but Jones threw at least one more and possibly as many as three more punches.
Steve McCarthy suffered head and eye injuries and underwent medical care for a few weeks after the incident.
Sunde said McCarthy supported the terms of the plea agreement.
The pre-sentencing report from the state probation office suggested an up-front jail sentence followed by probation.
