Judge Considers Kofoed's Fate
The fate of the Douglas County Chief Crime Scene Investigator is now in the hands of a Cass County judge. The state and defense gave their closing arguments in David Kofoed's trial for tampering with evidence.

The fate of the Douglas County Chief Crime Scene Investigator is now in the hands of a Cass County judge. The state and defense gave their closing arguments in David Kofoed's trial for tampering with evidence.

The prosecution presented it's case for four days, with the defense using just half a day, saying false evidence found in the murder case of Wayne and Sharmon Stock was simply an accident.

The prosecution said Kofoed planted the blood evidence in a car to wrongly convict two innocent men.

"Our job was to present to the court, the evidence that we believed was most indicative, of the allegations that were made against Mr. Kofoed, and we've done that, and how the court rules, we'll now wait and see," said special prosecutor, Clarence Mock.

"I still believe in Dave's innocence, and I'm so sorry for him and his and his family and the CSI division that they have to go through this, that they have to be kicked underneath the bus, all because a disgruntled employee, ended up going to the FBI in December 2007," said defense attorney, Steve Lefler.

Because the case is a bench trial, there is no jury. The judge is taking the case under advisement until Tuesday at 9 am. He says he will have a verdict at that time.
