Pleas entered by the drunk driver involved in a crash that injured four passengers in the other vehicle earlier this year.
49-year-old Danny L. Howell of Ceresco, Nebraska had faced a Class IIIA Felony charge but agreed to plead guilty to three Class I Misdemeanors. He entered those pleas Monday to driving under the influence (over .15 blood alcohol content) and two counts of third degree assault.
The Cassgram reports the prosecution and defense will jointly recommend three consecutive one year sentences in the Nebraska Department of Corrections where he can undergo the state’s alcohol rehabilitation program.
Howell was the driver of a northbound pickup that crossed the centerline south of Elmwood just after 8am on February 28th and struck a southbound SUV on the southbound shoulder.
The four men in their 60s were taken to the hospital, two had “prolonged hospitalizations,” said Deputy Cass County Attorney Steve Sunde. An expert witness would have testified Howell’s blood alcohol content was around .244 at the time of the crash, said Sunde.
