Update On Drunk Driving Sentence

Buccaneer Bay drunk driver sentenced.

This past July, a Cass County sheriff’s deputy observed a vehicle take a corner too wide at a high rate of speed in Buccaneer Bay, drive completely off the road on one side and then over-correct off the road on the other side. Arrested was 68-year-old Thomas Farry. It was later learned he had been involved in an accident a few minutes earlier. Two test results measured blood alcohol content at .273 and .223, said Cass County Deputy Attorney Rick Fedde.

The Cassgram reports Farry has been in Cass County Jail since the incident. He pled guilty to driving under the influence, 4th offense this week and sentencing came immediately after the plea.

Fedde said it was actually Farry’s 5th offense, a Class II Felony, but a plea agreement resulted in the Class III Felony conviction.

Farry was still on probation for his last drunken driving incident in Sarpy County in 2006.

Cass County District Judge Randall Rehmeier followed the recommendation in the plea agreement and sentenced Farry to 18 months to 36 months in the Nebraska Department of Corrections. His license was suspended for 15 years and he is to pay $1159 in restitution for the accident.

Defense attorney Gerald Johnson said it’s hoped that the state system has an alcohol abuse program that will help Farry.

Farry was credited with 128 days served.
