CSI Investigator David Kofoed took the stand Tuesday in his own defense.

Kofoed is on trial for civil rights violations, mail fraud, and altering records during an investigation of a double homicide. Evidence collected by Kofoed, in part led to charges and jail time against two men who were later found to be innocent.

Kofoed testified that he was "surprised" he got a positive on the blood evidence. But didn't think the evidence was any more significant than any of the other pieces of evidence because two people were already in custody. However, charges against those men were later dropped.

Kofoed was asked why he entered the wrong date on the evidence.
He replied "I wasn't thinking. It was eight o'clock at night when I typed the report.

The accused investigator said he wrote May 8th, the day he filled out the report, not April 27th day he collected the evidence. He said he must have written May 8th close to forty times the day he filled out his paperwork.

Kofoed also admitted waiting to fill out the report. When asked why, he testified "there's no good excuse, other than I was distracted." Prosecutors have started their cross-examination.

The trial is scheduled to continue Wednesday morning.
