Charges pending in Beaver Lake incident.

The Cassgram reports that the Cass County Attorney’s Office is waiting for further information from medical doctors before formally filing charges against a 21-year-old Nebraska City man.

“There definitely will be charges filed,” says Deputy Cass County Attorney Steve Sunde. The decision on whether the assault charge is a misdemeanor or a felony depends on how doctors classify the seriousness of the injuries.

30-year-old Steve McCarthy of Bellevue, who suffered eye injuries and head cuts, is to undergo further examinations this week.

The incident occurred Sunday, June 28th in a southeast cove of the lake where several boats were floating together. Sunde alleges Drew Jones struck McCarthy several times without provocation. He says there were “numerous witnesses.”

An on-call sheriff’s investigator and an off-duty Bellevue police officer were on a nearby boat. Both went after and apprehended Jones after he jumped into the water and went ashore.

Jones was issued a citation that day and posted the pre-determined bond for release from jail on a citation.
