Bates & Prostitute Testify

Council Bluffs City Councilman and former Omaha Firefighter Darren Bates took the stand in his own defense Thursday. He is fighting a misdemeanor citation for allegedly soliciting a prostitute.

Also on the stand Thursday, in a Pottawattamie County courtroom, the woman police used to lure the men into the sting that netted six suspects.

The woman, Kathleen Corley, was busted for prostitution in Council Bluffs. She began working undercover with police. She testified about her meeting with Bates.

Their meeting was videotaped. During Wednesday's testimony, people in the courtroom had difficulty hearing some of the exchange because of the poor quality of the recording. She maintains he wanted more than just a massage.

She said, "I said, 'Do you want a massage, everything, a blow-job, sex?' And he said, 'Everything', which is muttered on the tape. He nodded an winked at me and I said, 'Ok. I got it.'"

Bates said otherwise when he was on the stand later.

Defense attorney James Martin Davis asked, "Where it says inaudible on those transcripts, is that where you're saying you said massage?"
Bates answered, "Yes."
Davis asked, "Did you wink at her?"
Bates answered, "I did not wink at her."
Davis asked, "Did you nod your head?"
Bates answered, "No."

During Corley's cross examination, she seemed in awe at times of how detailed an explanation defense attorney James Martin Davis wanted. At times the exchanges were heated. So much depends on whether the jury believes Corley's story. During the cross examination, the defense brought out the fact that Corley was busted for prostitution by the same undercover cops she started to work with. If she worked as a confidential informant, she could get her case dismissed.

Attorney Davis remarked, "You were trying to manipulate this man."
Corley said, "In fact, I did."
Davis said, "In fact you manipulated him in terms of what you never succeeded did you?"

That answer will be left up to the jury.

During Bates' testimony, one of the first questions by his attorney choked him up - when he was asked to give the names and ages of his three daughters. But questions that followed did not show that family-side of Bates.

Davis asked, "You ever hear of the Razzle Dazzle?"
Bates answered, "Yes."
Davis asked, "Have you been there?"
Bates answered, "Yes."
Davis asked, "Ever hear of Lipsticks here in Council Bluffs?"
Bates answered, "Yes."
Davis asked, "Have you been there?"
Bates answered, "I have."

Questions about local strip clubs and an attempt by Bates' attorney to show he had gotten sensual massages before, and that's all he was after this time.

Darren Bates said, "I've had four sensual massages... Cause I wanted a sexy girl to give me, I wanted it to be sexy but I didn't want sex."
Davis asked, "Where were they?"
Bates answered, "Motel Rooms."
Davis asked, "Did you have sex with them?"
Bates answered, "No I did not."
Davis asked, "Did you offer to have sex with them?"
Bates answered, "No I did not."

Time and time again Bates said he again only wanted a massage, not sex, the day he was arrested for solicitation.

Davis asked, "When you asked her for a massage, what were you really asking for?"
Bates answered, "I wanted a massage."

The judge decided to end court for the day before the prosecution got the chance to cross examine Bates. That will start Friday morning. Before court broke, Bates' attorney filed a motion to have the charges dismissed. The judge overruled that request.
