Another plea tied to the September 9th, 2007 baseball bat beating incident in Plattsmouth —18-year-old Justin A. Johnson of Plattsmouth has pleaded guilty to 3rd degree assault—fighting by mutual consent, a Class II Misdemeanor.
It’s the original charge filed by the prosecution. The state agreed to remain silent at sentencing. The plea came the same day the case was scheduled for trial.
Cass County Attorney Nathan Cox said that had the case gone to trial, the state would have produced evidence that Johnson was on the phone with a girl from Weeping Water when Joshua Hauschild of Weeping Water got on the phone with Johnson and there was an "invitation to fight." Cox said Johnson and Anthony Houchin then fought in the backyard of the Tony Premo Sr. residence until it was broken up.
The events after that fight that resulted in the baseball bat clubbing of Premo have been in the news many times.
A pre-sentence investigation has been ordered and sentencing is set for February 5th. The conviction carries up to six months in jail, a $500 fine or both.
