I Kicked The Sheriff

Sentencing is January 5th for a 19-year-old Union man who has pleaded guilty to third degree assault of a peace officer, a Class IIIA Felony.

Four other counts against Jacob Ellis were dismissed in the plea agreement. The state will remain silent at sentencing but there is agreement that Ellis is to pay $1,562 in restitution to Cass County.

The Cassgram reports that according to prosecution statements in court and to the sheriff’s department account of a June 16th incident, Ellis was one of the individuals involved in a disturbance in Union that brought deputies to the scene.

Chief Deputy County Attorney Colin Palm said the deputies’ report said Ellis appeared "agitated and intoxicated" at the scene, was taken into custody and placed in a patrol car. Ellis kicked out a window in the car and was being placed in another patrol car when Ellis then kicked a deputy in the arms and legs, causing abrasions and scratch marks, said Palm.

The conviction carries a sentence of up to five years imprisonment, a $10,000 fine, or both.
