A Plattsmouth man was arrested Monday for shooting and killing a neighbor's 200-pound Rottweiler. He claims self-defense, but the owner says it was a cold-blooded crime.

Forty-two-year-old Leon Gehrig Sr. faces charges of animal cruelty, use of a weapon and criminal trespassing for killing the pet with a .22-caliber rifle just after 6:30 a.m. at 8th Street and Avenue G.

It wasn't a bark, but a dog's cry that startled neighbor Tim Endelicato. “A loud bang and then I heard her yelp."

In the pre-dawn hours, Tim looked for his neighbor's dog Maggie and followed a blood trail to the Rottweiler lying in the corner of the pet's own yard. “Blood coming out of the side of her, she wasn't moving and I knew she was dead."

Gehrig told police he shot the dog to protect his own pet. “But we had no evidence that a fight had ever occurred or that the dog was over on his property," says Plattsmouth Police Officer Ryan Crick.

The dead dog's owner, who wasn't home at the time, disputes his neighbors claim. “You can't justify that as self-defense,” says Richard Sweet. “She's in her own yard, he shoots her right there, I mean come on. Heartless, that's all it is, heartless.”

Gehrig is free on a signature bond and nobody answered his door on Tuesday.

The Endelicatos live two houses away and own the daughter of the shot Rottweiler. Tim and Geraldine are now concerned about having their pets in the back yard without someone watching them.

“Can't leave her out, you don't know if she's gonna get shot in her own back yard,” says Tim. “I'm not letting anyone hurt her."

Sweet says the shooting of his dog in his own yard is another loss on his family. “I'm losing my house and then I lose my dog, it's not right, it's not fair."

Before moving, Sweet will have to clean blood off his son's scooter, but a toy isn't like a family dog for a boy to play with growing up.

If convicted, Gehrig could receive a year in jail for misdemeanor animal cruelty. A deputy county attorney says a felony charge would only apply if there's evidence an animal has been tortured repeatedly and that does not fit the facts in this case.

You know what I think, some of you should actually find all the facts before you start posting stuff like some of you are. Do you know there neighbor on the corner who is blowing this all out of proportion has dogs that also attacked what is a block to do when the police department wont do anything about it, LET HIM GO!!!

Amazing that Mr. Gehrig felt it his right to murder someone's family pet in their own yard. The felony charge should apply not only to this man, but the Bellevue man that attacked his dog with a golf club killing it. What will these fine citizens do next? The actions of these men speak volumes about their lack of character and compassion to all God's creatures.

It will be interesting to see if this man is prosecuted. There is a double standard. The Omaha police get away with shooting, wounding or killing dogs at least once or twice a month, no questions asked by Mayor Fahey, Councilman Jim Vokal, the Humane Society, Internal Affairs or the County Attorney!

Good point... and you're absolutely right. Some dogs may tend to be more aggressive than other breeds, but that's not always the case.

No! We are not saying kill leon.Maggie never got out unless someone let her out.You must be talking about buddy the other rottweilers and that is why he is no longer in the are.You people are so stupid and don't know what you are talking about.Because i live across the street from leon.And he is nothing but trouble.Maybe i should go kill his dog and see how it feels not to have a dog.His Family needs help controlling there anger.

Maggie not only cornered my dog, but tore a hole in her belly. I've had a gun by my door for three years in case she came back. Didn't want to see it happen, and can't justify shooting it in it's own yard, but that dog wasn't innocent. It might not have been her fault, but something like this was bound to happen. If she had come into my yard and gotten frisky again, forget the shovel, I would have shot her and taken my chances with the police. Maggie was a good dog when she was around her family, but was vicious when she was around mine.

Rottweilers are not dangerous. Those trianed to attack or those completely undisciplined are dangerous- and this pertains to all dogs, not one particular breed. Perhaps this is something you learn when you are 17 though.

okay for one i would have done the same thing. for two if your moving take the dog dont leave it. NEGLECTION!! what were you thinking leaving the dog there in the first place if she was like another family member then she should have been at your new house not your old house. COMMON SENCE !! i grew up around dogs and i would never leave my dog at a house i dont live in. DUH!! maybe you should get a less dangerous dog. one who will stay in her yard kids run around what if she attacked a child?? no one thinks about that i say let Leon go. o and shoot him man slaughter 25 - life! NOT WORTH IT!! so i'd let this whole case drop it was a dog man let it go!!!!

im a neighbor to the gehrig's. and if he saids he did it out of self defense then i believe him i maybe only 16 but i kno that rottweilers can be dangerous. but in this case he says he did it to protect his dog then so be it i would do the same for my dog.

TO ANONYMOUS 2:24PM--The dog was agressive and did attack my dog and other peoples dogs in the neighborhood. By saying I escorted it back I am not contradicting myself. I am not scared of aggressive dogs. I on more than one occasion had to authoritatively yell at the dog to get it to go back into its yard so I could manage to get into my vehicle. If she would have tried to attack me or a member of my family including my lab or beagle I would shoot it. It did not try to attack me but did corner a dog in the neighborhood until a neighbor took a shovel to its head. The cops were called. If an animal of yours is getting attacked or chased by an aggressive dog your not going to stand around and wait for the police while it continues to be attacked. I like Leon and the people that owned Maggie. I only called the cops to get her put back into the fenced in area they kept her in. By escort I don't mean she went calmly only that through confrontation she went back to her yard.

I do agree that it is a sad situation, but you people act as if that dog were a human, and that Leon should die also because he killed it. I think he should receive proper punishment, but there is something wrong with a society that holds an animal's life as the same value with a human's!!!

I can't believe that "use of a weapon" and criminal trespassing are misdemeanor offenses, especially when firearms are involved. I hope he gets the maximum... Even if the dog was ill-behaved or barking early, even if there was a history of bad blood, it's not the dog's fault. That was cruel and sick, and it makes me ill to think I have Gehrig for a neighbor. I'm afraid to put my dogs out now, too.

To Anon: You make no sense. You say many people were afraid of the dog and that it got loose many times. But, you also state Leon and yourself escorted the dog back to its yard many times. How were you able to do this if the dog was so "aggressive?" Obviously it wasn't that mean if you were able to handle it on many occasions and return him to his yard. I feel bad for the dog-sounds like it didn't come from a good loving home. I'm sure it was kept outside all the time, which I still don't understand why people get pets just to leave them outside all the time. Poor baby.

Can't tell clearly, but it looks like Richard's back yard is fully-fenced. How can the shooting be in self-defense of Gehrig's dog? I'd like to hear about the history between these neighbors. I'm guessing there's more to this story than we're being told.

I feel sorry for leons kids what they must be going though knowing that their dad would do something like this.. What a good role model. I think the whole family needs some counseling now. I hope they throw the book at him. They say there was no evidence of repeated torture dont you think the fact that the dog ran through the yard in pain until it died torture enough. He did it he admits it and should pay dearly for it.

What was the dog doing outside alone while the owner's weren't home? It should not have been shot if it were in it's own yard, but being unattended it is very hard to prove. Poor puppy. Poor humans.

He should have contacted law enforcement and let them handle it. If his dog has no visible signs of being attacked then he needs to receive the maximum as a sign to everyone. Our pets are many times like our family...no one has the right to kill anyone else's animals! Neglect should hold the same penalties as child neglect and they should be banned from ever owning another pet.

I would of understand if there would have been some type of markings on his dog to show that the rottweiler attached his dog. still the rot was in her own yard he had no right to shoot her. If the rot was in your yard fitting with your dog no one would have a problem with you shooting her, but she wasn't she was in her own yard and you trespassed onto there property and killer there dog. You are a heartless man.

While I feel very sorry for this man, I would never leave my dog out in the back yard and leave or even just go back in the house. I know a lot of people would, but this is what can happen when you leave your dog unattended...they can get killed, stolen, in a fight with another dog, a child could wander in the yard. Different strokes for different folks, but I take my dogs out and they come right back in and I watch them the whole time they are outside.

It's funny that you say the dog got out many times and had a history of scarring the neighborhood. That wasn't this dog, it was another rott they had and that was the reason for getting rid of him. And saying this dog has been neglected that is just false. This is really not the point of this situation. This dog was killed for no reason in it's own back yard. It was not in the killers back yard. So there was no reason to do this crime hate.

Maybe if the owners took care of this dog, their neighbor wouldn't have had to shoot the dog! I wouldn't have thought twice about shooting this dog if it lundged at me!

When this story first ran, the story did not mention the breed of the dog, nor the size of the dog. A 200 lb Rottweiller? Not that's a bit different than, say, somebody's little Schnauzer.

We'll have to let it come out in court. I, for one, am not a fan of Rotties. We used to have a family next door who bred them and the mama dog came after my oldest daughter when she was 4. If her dad hadn't stepped in, I don't know what might have happened. I'm not saying all Rotties are bad, but I just wouldn't have one myself. I think if this dog was guilty of something, this neighbor should have spoken with the neighbor first. We spoke to our landlord about the dog and he had no idea the family was doing this and they were soon gone.

There is no reason to shoot a perfectly healthy dog. This happened to me when I was younger and I watched it happen. Idiots and guns don't mix. Throw the book at him.

Marylou this does not say that there was any signs of neglect on that animal, and other commentors who have known the dog have not said it was neglected as well. But for you to state that the animal is in a better place after being killed for nothing is cruelty and lacking empathy. If the dog was on another part of property, not the homeowner's then the man had right to shoot it if it charged him as if it were going to attack. Still this is fishy at best, for someone else to say that the man wanted a kennel of theirs, well something is going on that left a poor dog dead and a fat freak thinking he's going to get away with it. Either way leon is a killer and his petty excuse that he was trying to protect his pet just proves how feeble minded he is. Since the dog was shot on their property, either his pet was on their own or he was. And he needs to spend jail time, a simple 1-5,000 dollar fine won't do.

They just need to throw the book at this guy if the dog has not bitten or attacked anyone then there is no reason to kill it let him spend about the same amount of time you would sentence a person to behind bars for the same crime.

This kind of behavior just makes me sick to no end. It is "NOT OK" to shoot an animal, especially in his own yard! Poor thing. What is the matter w/ this guy!!! If for some reason he is "scared" of the dog, he should have spoken w/ the owner, or the Humane Society. He needs to go to jail for awhile, understand what he did was a terrible thing! I will pray this guy gets the maximum time spent in jail. I feel sorry for the dog's owners. May God watch over you during this time of great sorrow.

NEBRASKA NEEDS TO MAKE HARSHER LAW AGAINST CRIMES AGAINS ANIMALS. THE CRIMINAL ONLY GETS A MINOR FINE OR PRISON TIME THAT IS REDUCED TO NOTHING. THESE CRIMES ARE AGAINST SOCIETY. Whatever the motive was is really irrelevant. A dog has been KILLED....and no dog should have to suffer being shot. It does not matter if this dog has been picked up a million times by animal control, it did not deserve to be killed. Dogs are domesticated wild animals. It is natural for them to roam....and if the dog was allowed to run the streets, it certainly didn't deserve death. It was only doing what dogs do naturally! Maybe the owners should be ordered to pay higher fines to get the dog back when impounded (if that is the case)....even if it means the dog ends up HUMANELY euthanized when they can't afford the fines. It would be better than being shot. It concerns me that a human being could do this to a dog. What might they do to a human when they feel threatened??

What was this dog's infraction? Did he bark at the paperboy? Did he whizz on the lawn of this doofus shooter? Was the doofus shooter under the influence of something? Be VERY PROUD of yourself, Leon. You're a REAL MAN! I suspect you are also an avid fan of 'wrestling' and monster trucks.

My dogs are like my children. I cannot imagine losing them in such a heinous way. If he could so easily shoot and kill someone's beloved pet, imagine what will happen when he gets ticked off at another person!! The very thought of this disgusts me!

This dog, from what I know of the situation for years, is much better off now. This family has neglected this dog, over-bred it, and all one has to do is check the number of times it has been picked up by the humane society to see how much this dog really meant to them. It is just a sad situation all the way around.

I don't know why Leon killed the dog. I lived in the neighborhood a few years ago and am familiar with Leon and the dog in question. The rottweiler in question has gotten out multiple times and everyone in the neighborhood was scared of it. While I am sure the dog will be missed many people have tried to get the dog taken away from the owners. I myself went out armed when the dog was out and the police wouldn't respond. In the past I had taken the dog back into the yard when it was roaming the street. Leon had escorted the dog back as well many times. I can not imagine that Leon shot the dog while fenced in the back yard. If he did it is criminal trespass. What needs to be known is why he shot the dog. Jamie stated that it was because he wanted the kennel. He may very well have wanted the kennel but I am not sure if that was his motive. Leon knows the law and his rights. I am sure we have not heard half of the story.
