Yankees pitcher and former Husker Joba Chamberlain is fighting a 90-day license revocation after an October arrest in Lincoln for suspected drunken driving.

Chamberlain's attorney filed a petition in Lancaster County District Court Wednesday, asking that the decision to revoke his license be reviewed. Nebraska's Department of Motor Vehicles made that decision.

Attorney W. Randall Paragas of Omaha says the revocation and the law supporting it violate Chamberlain's right to due process and equal protection of the laws.

The 23-year-old pitcher hasn't been charged and is to appear in court December 17th. His blood-alcohol content level when he was pulled over for speeding on Oct. 18 was 0.134. The legal limit in Nebraska is 0.08.

Apparently basic math eludes you. Twice the legal limit would be .16. And nice try, but this won't work. Take your 30 days, get a work permit or an interlock, just like everyone else for the remaining 60.

over twice the legal limit and his lawyers are fighting his 90 revocation. What makes him so d*mn special. He broke the law make him take his lumps like everyone else the breaks the law.

They should change the law to a one year loss of license for first offense not 90 days.

All lawyers try this and it never works. I thought Joba said initially he was going to take responsibility for his actions? Guess not.

Joba..Joba..Joba. I have the utmost respect for you even if convicted. But please don't fight something when you know you were in the wrong. Take the punishment,learn from it and don't let it happen again. You were speeding,you were "legally" intoxicated..Be a man and don't dissapoint the kids who look up to you. Heck I am a 40 year old man,with a DUI of my own. But I still,believe it or not,look upto you and follow your every appearance on the mound,even though I hate the Yankees..lol
