A Heartland man, charged with murder, four first degree assaults, and five counts of using a firearm in the commission of a felony is being held without bond.
Twenty-two year old Jeremy Foster is accused of opening fire on a crowd of people in the parking lot of the American Legion Hall at 33rd and Parker.
Killed in the hail of bullets was 25-year old Victor Henderson, several others were injured in the attack.
According to court records, two of the victims identified Foster as the shooter.
Foster denies this, the public defender representing him at the hearing said, "He (Foster) states he has an alibi" and that "he was misidentified".
Leaving the Douglas County Jail, Jeremy Foster's family and friends have nothing to say. They are upset because Foster was denied bond, despite his pleas of innocence.
Juarquate Brown says, "We just want the killer or whatever to be arrested you know so we can just feel better about our, the situation."
Victor Henderson's family was relieved that an arrest was made quickly.
"By all accounts, what happened out here was chaotic. The shots were fired, people running for cover, others running away. In the middle of it all Victor Henderson lay dead. Jeremy Foster says in all that confusion the witnesses who are pointing fingers at him, are wrong."
Some members of Victor Henderson's family do not want their faces shown. Lou Edwards, another of Victor's sisters is one of them. She fears retaliation, but says she believes investigators arrested the right man.
Lou Edwards says, "Three people actually seen everything so we knew it was just a matter of time before they caught up with them, get them or whatever."
Ironically, the Henderson and Foster families go way back, the older kids grew up together.
Juarquate Brown says, "It kind of hurts to know that someone in their family took out one of our family members."
Victor won't be forgotten, in fact, he died breaking up a fight. His sisters say that's the type of man he was.
Judge Susan Bazis ordered Foster be held without bond, and set his preliminary hearing for Wednesday, January 7th.
