Voters Tuesday approved a ban on government-sponsored affirmative action. Initiative 424 prevents discriminating against individuals or granting preferential treatment based on race, ethnicity or gender.

With 99 percent of precincts reporting, Initiative 424 passed 58 percent to 42 percent. It will amend Nebraska's constitution on the hiring or recruitment at colleges or other public or government institutions.

The amendment caused concern among many voters who found the wording on the ballot confusing. One Channel 6 viewer said his wife has a master’s degree in chemical engineering and had to text a friend to make sure she was voting correctly.

"I think that the people are speaking pretty loud and clear that this is a principle that they believe in and want to see embedded in the constitution of this great state,” said Civil Rights Institute president Ward Connerly.

Connerly led the effort and helped get similar measures passed in other states. "Many people in this state have shared with me their stories about race being used inappropriately, faculty hiring in the city of Omaha and other places and this initiative will forbid that."

He says the initiative stands to end programs to recruit male nurses or scholarships for Germans or other ethnic groups.

The University of Nebraska Medical Center Vice Chancellor of Academic Affairs Dr. Ruben Pamies says the effects of 424 go much deeper.

"We have a task force in place, looking at all the languages and all of the different programs that we have to make sure we abide by the law."

He says the initiative could end certain scholarships or programs like recruiting male nurses and it jeopardizes the Virginia-Nebraska Alliance in which student Bryan Spells takes part.

“They're trying to recruit students as well as faculty and staff here in Nebraska to diversify."

It's not about numbers, he says, it's about health. Spells was involved in research for diabetes, a disease with racial disparities. He says he was able to enroll crucial participants because he could relate to them.

"They could express more about themselves than they could going to somebody that they didn't relate to."

Dr. Pamies worries the Med Center will lose diversity, like other states which have passed similar initiatives. "California has seen a reduction of 65 percent, reduction in their enrollment over the last 10 years, of minorities.”

A lawsuit by Nebraskans United claims 424 backers used unfair tactics to gather signatures and get the issue on the ballot. It aims to get strike the measure down.

"And ensuring all of us who make laws through the initiative process follow the rules and adhere to Nebraska's election law process," says Danielle Nantkes of Nebraskans United.

Dr. Pamies says affirmative action measures are still needed to ensure all Nebraskans, regardless of their socio-economic backgrounds, have equal opportunities. "I think there's going to have to be a point where we don't need them anymore, but this is just not the time right now."

Initiative 424 will take effect January 1st, unless that lawsuit filed by members of Nebraskans United stops it. The matter is in the hands of Lancaster County Judge Karen Flowers. No word on when a decision may come. Whatever the outcome, this case may very well end up in the Nebraska Supreme Court.

"Equal Rights" is misleading verbiage folks. This is not an "Equal Rights" amendment. We ought to think harder and longer before we amend out state constitution with this garbage. Wake up people! This is a stupid amendment, forced on us by stupid people from California. I can only hope that Judge Flowers will protect us from our own stupidity!

I cannot understand how we as a country are supposed to "see beyond the color of one’s skin" if that person's skin color is almost always used as some type of weapon against everyone? If you want people to see beyond skin color why point it out ALL the time. Most people can see, and believe it or not, skin color, race and gender are just about the last things that people are judged on; heck as a country we've elected a black president! People should be judged on ability, effort and commitment. The commitment comes from if you got an education or not which should give you the ability to do the job, however if people don't put out the effort required to do the job, the next step is usually; I'm of this race and you're discriminating against me"! Now with this out dated law repealed, you don't put out the effort, they can let you go and find someone willing to put out the effort to do the job!

This issue was decided by the voters, Affirmative action has had it's time, and now that time is over. When affirmative action was conceived it was needed to give minorities a chance to get into the workplaces in adequate numbers to make a difference. Now that time has passed, it seems the only one crying discrimination is the ones that know they would not have a job if it was not for this law that was just voted out. I feel if minorities want TRUE equality, they are going to have to quit yelling discrimination every time something does not go their way! They will have to produce a marketable worth instead of hiding behind an outdated law and just filling a slot because the law says it has to be filled. Now all people; black, white Hispanic, man woman, and even Martian will have to WORK for and earn the jobs they hold!

Ok, 424 has passed. Now since there can be no discrimination and the people of the state have voted their wishes there are some things that the people didnt think through. First all state sports activities will have to include only the best qualified persons. 'Womens' and 'mens' teams can be no more. Every person should have equal status in sports as well. No more womens teams, just teams. If a male tries out for a what used to called a women basketball team the coaches will now have to justify if he is better than the women who try out and he is not selected. No more sports scholarships for women or mens teams. You see under 424 this can not be. Sports teams are not federally funded. Thats what you all get for listening to someone from California, who doesnt and never will most likly live in Nebraska. Discriminating with sports teams are also wrong arent they?

When I worked for a major Omaha Corporation, I wrote a very excellent computer program. We had a white female manager and a black female employee that deliberately conspired to run the programs in a fashion that destroyed the perfection in the program. My job and other white male jobs were abolished because we were white males. The females white and black were unable to understand the basics of running a computer program, let alone the education to write a program. When the company needed someone to handle the complex y2000 work, I did that as the females could never handle such a chore. So, this prejudice by management white and black women against men, and any law to give them advantages doesn't work. One must have character. As a foster parent I rasied a black boy, I was a missions director and entertained many blacks from South Africe, but the 97% of blacks voting for OBama and the 47% of whites voting for OBama give you a referance point to decide.

Why do we vote on things if things are just going to end up being a court decision. What happened to the people's vote being the final verdict. Why are citizens wasting their time in voting booths when essentially their votes on initiatives and propositions which are going to be protested? On another note - The wording is completely confusing. Istead of answering yes or no. Why don't they make the choices something like: Yes- Continue Affirmative Action or No- Ban Affirmative Action. List the initiatives in simple language everyone understands. Do away with all the technical legal mumbo jumbo!

They are going to make sure that this works on all fronts right? Because everything they try to pass involving this very problem comes to give hispanic or african american people more privleges then other ethnic backgrounds. Just look at all the scolarship opportunities they are given already, for the sake of making them feel empowered. Everyone in this country should be given the same chance, not pass some by and aid others due to, lets face it folks, plain out guilt. This race thing is rather hilarious if you think about it. The mentality comes down to complaining of unfair treatment due to ethnic background that is until it benefits you. If everyone just stopped with the whole charade then we wouldn't have to do all the work to appease certain groups and leave others in the dust. Think about it....

People have also got to remember that certain jobs have bona fide qualifications for a person to have to have (like Hooters doesn't hire waiters and construction firms hire more men due to the equipment they have to use) and that is NOT under Affirmative Action.

That's just what I need: a "College Professor" telling me I'm a racist and a redneck! Is he even smart enough to recognize the irony? Judging by his grammar, he received his position through AA, and his students will suffer for it. I'm glad he's leaving the state! And "Remember this is NE!", too, who doesn't trust "us" to make a decision to hire the best candidate. Oh, yeah, as if employers consistently seek out bad candidates so they can be less competitive in the business world. Do you two even realize what gives minorities and women the "unqualified" stereotype, today? It's Affirmative Action. Minorities and women don't have to work as hard to get their degrees as white males, so when minorities and women enter the workforce, they're perceived as less valuable. It's not that hard to figure out. People who defend AA want to take the easy road, but also want to complain when the pay doesn't come with the lesser education. So please leave Nebraska. We'll be better off without you two.

Rich, overall I've agreed with your comments, but I need to correct you on one point. Affirmative action doesn't force employers to "seriously consider" unqualified minorities and women. Affirmative Action sets quotas, and if the only minorities and women available are unqualified, employers are forced to hire them over their qualified male counterparts.

I understood exactly what 424 was and I voted to get rid of the bill, because I've seen far to many times a company hire someone who isn't qualified for the job, just so the company has it's "quota" and not only that, it's unfair for a person who is qualified for a job, to get turned down because you won't meet the company's quota.

TM, what may seem to you a racist remark by Mel happens to be the truth in so many cases. I see it DAILY in my line of work. Sad to say, some want a hand out and have no interest in working. That would interfere with their sleeping in and whatever lifestyle they have become accustomed to. They have all kinds of reasons why they cannot go out and get a job. Alcohol and drugs play a part of it but that is their choice. It is not because they do not have a job but something they rather do. Sorry how it sounds but that's the way it is and with all different backgrounds.

HeyStephanie,the reason they want to hire men instead of women(regardless of size or strength)is because as soon as a women gets hurt doing it,they will calll James Martin Davis and sue that compznt,because they mad a woman lift heavy objects. The fact is AA screwed over many morer non-minorites,than not having it will screw over minorities.

The paper printed sample ballots you could view them on line or get them from the election office. Don't cry now because you didn't know what you were voting for. Just because you have a masters does not mean you have the common sense to go with that degree.

Nikki, just like the rest of the 424 opponents, has to blow this all out of proportion and to try scare everyone into thinking kids won't be eligible for scholarships, or somehow that employers won't be allowed to hire minorities - ridiculous, all of you! It is about being able to hire the best person for a job, not being forced to find a minority who may be underqualified in order to fill a quota. If I am a medical patient, then I want the BEST doctor based his/her skills - not the one out of all the applicants which may have flunked Anatomy three times, but happened to have the correct genetic makeup to meet the quota. Discrimination against a racial majority is still discrimination, and it should be illegal. That's why I voted FOR the ban... and I was smart enough to understand the ballot. And I guess that shows I am better-qualified for most jobs than the chemical engineering "whiz"... gee, maybe she only got her degree because she was female, not smart...

I voted for the bill. The only way this society will ever get to the next level as far as "racism" or "sexism" is concerned is for people of all races and ethnic backgrounds, men&women,to want fairness extended to all people. The days of your persecution have been over for a long time now, stop clinging to it and stop raising your kids to be bitter. When fairness is applied as far as getting a job, being admitted to a school, or earning a scholarship then everyone knows where they stand and instead of whining and demanding special treatment your choices are now more realistic and rewarding. Go get more job training or volunteer to get some experience, work harder to get better grades. Can someone here who is for AA tell me why a white male who is poor, worked hard in school and deserves a scholarship should be passed over for any non-deserving female or minority? Reverse discrimination on this child cannot change the past but will guarantee that the cycle of bitterness continues.

This bill didn't hurt us people. If you can't get a job on the merrits of your ability, then you shouldn't get that job. Your race, or gender should not matter about getting a job, and it is high time that we were rid of that stupid law that said that the more quallified person couldn't get a job because he/she wasn't the right race, or gender.

I, too, thought the language was VERY confusing. Why wasn't Affirmative Action used. I ended up voting no because of the word discrimination when I would have voted FOR Affirmative Action. I think the wording was deliberately confusing and I'm sure alot of voters were not sure what they were voting for. I think this should be decided in Court.

Jenelle, I have worked in the corporate world for 35yrs and have on too many occassions seen college educated,other than white men and women, men and women get passed over for promotions that unqualified people get. There is no such thing as fairness.

Ok I don't buy what your saying and here is why. I applied twice to be an Omaha Police officer. The 1st time I was told that my scores were exellent BUUUUT, they were only hiring minorities. The second time I applied I was told my scores were excellent BUUUT, they were looking to hire minority woman. Each time I applied I scored no lower then 2nd in my class. Now, was it fair that people with lower scores and that were less qualified then myself were given the job, just because they were minorities, or woman. I think not! This antiquated thinking needed to dissapear, plain and simple. Remember, CHANGE WE NEED!!!!! Deal with it!

Or are you saying minority/low income students won't go out and get scholarships on their own? In your own words, "There's [sic] scholarship opportunites [sic] for EVERYONE...if you're too lazy to research scholarship chances, don't whine and blame others for your laziness." I had absolutely NO problem understanding what we were being asked to vote for. I don't think we need affirmative action anymore, and I am a female. I am also currently unemployed after being laid off from my last job, and partially disabled, which prevents me from working any physical job. But you know what? I don't NEED affirmative action. I am putting myself through school with financial aid and school loans and I will LEARN to do something new with my life so that I can become successful in spite of my disabilities. Anyone who thinks we NEED affirmative action is just TOO LAZY to get off their butts and make something of themselves. Get a job on your merits, not your gender or your color!

Cole, He is not telling us what should be in our Constitution. He simply ran a petition to get the issue on the ballot and the PEOPLE said yes to it. We, Nebraskans, are the ones who amended our Constitution. And as for the wording of the ballot as many here have suggested, it was worded perfectly. The ballot clearly stated what a yes vote would do and what a no vote would do. And yes I voted for the Initiative. I'm tired of being denied scholarships because of the color of my skin (and yes I have tried them just to see if they would play the race card. as I met all the rest of the requirements race was the only reason to deny me). Just imagine the outcry if a scholarship was available only for white people, Do you think their would not be a outcry against that? If a scholarship for Whites only is wrong then so is one for Black, Hispanics, or any other group. One should only be rewarded for their action or performance, not the color of their skin.

Explain this to me. When you apply for a job or try to rent a house, you don't want to be discriminated based on sex or color of skin. Your sitting in front of the person interviewing, they see you, they know your sex, and your skin color. Yet, if they base a decision on these things, its discrimination. Yet, a law has been passed that eliminates the knowledge of skin color or sex when applying for something and suddenly its discrimination? Personally, I feel the scholarships that gear themselves toward a particular group is being discriminatory to everyone else.

Just for all those reapeating yourselve's. Nobody is denying that the intent for AA was good. The point is, it isn't working. “They're trying to recruit students as well as faculty and staff here in Nebraska to diversify." I'm sorry, I thought my tax dollars were going to recruiting only qualified applicants. And if there are thay many qualified minority applicants, recruit them I don't care. Just don't disclude qualified applicants that aren't minorities. Especially after reading this article.

As a black woman, the last thing i want to be hired for is to fill a government-mandated spot for either a black or a woman (or both) instead of my real qualifications. I voted "yes"!

This goes out to KRM. I am so glad that this amendment passed. I worked at a Casey's gas station in the morning to pay for college and a telemarketing place at night to pay for my bills. I did college all on my own. So anyone who says they can't go to college because they didn't get a scholarship, are the lazy ones. There are no race descriminated scholarships based off of academics. They're scholarships that give minorities money to go to college regardless of scholar or merrit. Those people have no right being in college. I was given the option because I worked hard in school, and worked hard earning money for school. I think they should do away with scholarships comepletely. Then we'll find out who deserves to be in college and who doesn't. Those who are willing to work for it deserve to be in college. And no, working hard in sports does not make you deserving of a free ride to college, minority or majority!!

I wonder how many people actually realize that this bill is going to hurt us. Our educational system will be striped of eligibility for countless national scholarships and programs that specifically target certain groups, with no substitue. That's thousands of dollars that our students could have used for education. Our state can only hurt because of this and I am hurt that it passed.

I think both ways on AA. I think it is necessary b/c you have people who still view black as a stupid lazy thieving race and some who view women as the lesser of the 2 sexes. That is the reason this Action came into effect. It would be nice to not need it as a country, however most of us who voted against the change it was because we don't have faith in employers to hire people based off their qualifications. What more do we want we want fairness without force and griping. I think I want my daughter to get a return on her investment in education just as quick as I did. I have 2 college degrees and I am only 28, so part of me feels yes I worked hard and earned it but b/c of how things used to be I couldn't say for sure if it was AA that got me there or not. That's sad. What's sadder is that people feel you don't have to be qualified for a job under AA if you fit into a minority, not true as a teacher I had to go through everything my counter parts went through to get my job.

Ah yes, nice to see that racism is still alive and well in Omaha NE. For those of you who think scholarships for minorities are a violation, for some households, a scholarship means the chance to continue one's education and still have money left over to buy food or pay the rent. To you white people whining about no scholarships for 'whites', get real! There's scholarship opportunites for EVERYONE whether you're black, white, pink, purple or polkadot; if you're too lazy to research scholarship chances, don't whine and blame others for your laziness. But since Omaha voted to approve discrimination, I guess the opportunity for many minorities/low income households to improve themselves just got tossed out the window. Hope all you who voted 'yes' are real pleased with yourselves.

I can't believe the comments made by "educated" people in the segment. I am 100% against recruiting minorities. Not because they're a minority, but because there is less vocus on recruiting QUALIFIED individuals. In my opinion, the only kind of descrimination UNMC should worry about is this: Those who are at the best at what they do, and those who aren't. If a minority(male or female/black or white) is qualified, they'll be hired, just ask Obama and Clinton.

so i keep reading about how it helps african americans and ladies against the "isms" but its funny because my boss currently favors men.. by boss previously favored ladies.. its not the law that needs to change its people. i personally dont agree with AA because yes i do think it is unfair. and i dont think we need to be dwelling on the past, im sick of hearing "my ancestors were forced into slavery and..." yes it was unfair and terrible but unless it effected you directly then dont use it as an excuse. the problem is ignorance and hate. its sad that everyone has to be so hostile. so take a deep breath, smile, and start thinking of others.

People that are more qualified dont get jobs cause you "have to hire an ethnic person", AA should be ended. Having to hire "an ethnic person" is reverse discrimination towards whites.

Affirmative Action was a step that needed to be taken at the time. I believe that it has now outgrown its usefulness. In too many cases it is now being abused or used for reasons not intended by its authors. We have grown so much as a nation since our Constitution was first written, but we as Americans may not be ready to proceed forward without some sort of measure replacing it. Instead of trying to resurrect an outdated law, let's do something worth while and first identify what we need (if we need a new law), then work to make that vision a reality in the modern world we live in today.

I am a white woman and an OIF veteran and I agree with Curt - Equal Oppurtunity and Affirmative Action are two different things. Affirmative Action is not used as it was intended when it was put into place JFK and Lyndon B Johnson. I researched it, I read the orignal bill and the way it is used today is not how it was intended to be used. Furthermore, I feel as though AA sets a lot of people up for failure - as they are not qualified for a position but get it anyway based on their race or sex and then do poorly at the job. And all this from an uneducated hick Nebraska white girl...whodda thunk it?

I read the wording one time and understood that a vote "for" 424 meant you wanted affirmative action ended in NE. I voted "for" the measure, and the fact that an African American was elected to the highest office in the land is proof that aa is an idea whose time has come and gone.

The path to equality must be equality. Since when did discrimination and preferential treatment become the cure for discrimination and preferential treatment? If you find the wording on ballots confusing then you can just opt to NOT vote for that amendment. There's nothing that says you must use your pencil to fill in the oval on every section of the ballot. Voting for a measure that you do not fully understand is irresponsible. If you don't understand then don't vote one way or the other on it.

I was asked 3 times to sign the initial petition. Once at the DMV, Once at Wal Mart, and once at the Post Office. All 3 times the petititoner specifically used the language "to repeal affirmative action". Plus I don't think the balloot was confusing. In ANY ballot measure if you feel that you are against the measure, then you want things to be the same. If you support the measure, then you want the change. And as many have said, do some homework. Get a sample ballot, listen to the news, find out what measure number is what. I am sorry if some people chose the wrong answer that corresponds to how they felt. I am sure some people voted for when they meant against and vice versa. The wining margin is 100,000 votes. I can't see that many people were confused one way or the other.

God Bless you all souls writing these racial comments! I truly hope that the right decision was made in Nebraska and we can show the nation how to live without Affirmative Action. If not, God sees your hearts...if you can't love your brother(who may be black, white, yellow...whatever), then you don't love God(1 John 4:20-21). I hope you know we truly do look like hicks(Safe Haven, No Affirmative Action, and states that can't survive without football)...its quite sad actually. My thoughts are what makes you may be qualified to get a job over someone else with real struggles? Maybe you weren't as qualified as you thought. Maybe you didn't have the resume, maybe you didn't have the gpa, maybe you didn't have the skills, maybe you didn't have the life experiences the employer was looking for. Regardless of color, some find it much more convenient to sit on their butts at home and get all of the government assistance they can. You have to actually go and apply for a job before you can get hired.

I just love how people call Nebraska uneducated when we have one of the highest average of ACT and SAT scores in the country. Just because you don't agree with someone doesn't mean they are uneducated or stupid. California and New York schools would love to have the SAT and ACT scores that we have. So please don't go around spreading that Nebraskan's are stupid because it's just not true. Now this is just my opinion, but if you have to insult someone because you don't agree with them, that just shows how ignorant you are. And this goes for both Republican's and Democrat's. Granted I wasn't for Obama, but I don't hate the man. We have a difference of opinion. I also don't hate my friends that are democrat's on most political things, we just agree to disagree. What hippocrites we are! Forget about all the horrible things that have been committed against minorites, women, and different ethnic groups the forty to 300 years past. Just focus on all the racism and sexism that is still happenning today. Yet something like affirmative action is put in place to help level the playing field in this society, and nobody cries racism louder that the poor white male! In a relatively short amount of time, our children and grandchildren may actually have a legitimate reason to say they have been discriminated against when the white race is the minority in this country. Hopefully, those in the majority will behave better than we have.

For those of you who marked your ballots incorrectly because you couldn't understand them: that's why the paper prints sample ballots in advance and the Douglas Co. Election Comm. has them online. That way you can read them BEFORE you get to the polls, study them, go online and research them. You can even bring your sample MARKED ballot with you into the voting booth. Matter of fact, I (as a poll worker) encourage it - it speeds up the voting process. Personally, I didn't find the wording confusing, but I don't do chemical engineering, either - we all have our strengths.

I think most people on here that think banning affirmative action is bad are a little confused. I believe they have equal opportunity and affirmative action as the same thing, which they are not. Equal opportunity says (in a nutshell) that you can not discriminate based on sex, race, religion, etc. Affirmative action (in a nutshell) says you HAVE to have a certain amount of minorities or face penalties and thus making it so people that are less qualified get better jobs than those that are more qualified.

Companies work hard to show an earnest effort to meet their AA goals. This can mean that someone who is more qualified gets passed over for a job because they are White. This is not right. AA basically states it's okay to discriminate if you are discriminating against the right people - PERIOD. I struggled to pay my own way through college and was disqualified from several scholarships because they were for minorities only. What would happen if there were a scholarship labeled for White applicants only? Yeah Right! There would be an uproar. Discrimination is just that, no matter what way it's going. Hooray Nebraska!

AA doesn't put unqualified women and minorities in jobs, it makes sure that qualified women and minorities are not looked over time and time again. These same people may have to make a hiring decision, and frankly I don't trust you to make a decision to hire the "best" candidate. To those who commented on my first post: I applied to be as stocker at Bag-N-Save when I was in college when I first moved to Omaha. It takes a long time in Omaha to obtain a job (of any kind) because of interviews. I was looking for a job to pay the bills (because I do not want to live on the system)!! I got turned down for being a GIRL! You wonder why so many people are on the system! I can lift more weight than many male counter parts and grew up on a farm with the work ethic that America SHOULD have! I work my tail off for everything I earn and do not look for handouts, but when someone tells me I can't have something because I am a GIRL? That is WRONG!! I used to work 3 jobs (110 hours per week) so don't tell me I am lazy either! And my male counterpart at work has no experience in the field and makes more than I do when I have 4 years of experience! You tell me how that is fair? Yes maybe Affirmative Action isn't working for me now, but it would be much worse without!

If you apply yourself in school, learn proper speech, learn basic manners, work hard, have a good attitude instead of an "I'm such a victim" one, practice proper hygeniene, and make yourself as marketable as possible for the industry you're in, you should not need affirmative action. We moved around a lot and I went to school in some pretty crappy school districts but I took some initiative and learned on my own. I studied hard and worked hard to get where I am today. No one can take it from me and I've never felt discriminated against for being a woman in a male dominated industry.

How was the ballot confusing at all? I read it once and knew that if you voted for it, you were banning affirmative action. It said that clearly. Also, if you didn't know how to vote, don't vote. Simply said. Or else maybe you could ahve watched the news (which I never watch, but caught for a second) and they even spent time discussing what it means for a "For" and "against" vote.

Affirmative Action is actually a good thing. Enforcing affirmative action ensures that the most qualified person gets the position. Regardless of whether its a student applying to get into college, or someone applying for a job, the most qualified person should be awarded the position. One should not be accepted because of race, ethnicity, etc, just to meet a quota.

To Stephanie, Now I know you probably won't believe this, but women actually make more then men, given the same criteria(same jobs, same experience, same education). Yes, women on average make less but there is a reason for that. For example, a women staying home with the kids for 5 or 6 years. That takes away 5 or 6 years of raises and experience. So are you saying that a women with 5 or 6 less years of experience should make the same as a man who has the experience? Another example is that women tend to take jobs that are more flexible for the sake of there family. Now not all women do this, but I am just going off of stats. Check out the following website. Not the only vote where people thought they were voting for what they wanted. But, on topic I voted yes. AA it may not have been reverse racism but it was racism. As a white woman I have been asked questions over the phone and on applications that had nothing to do with my qualifications and everything to do with my race, minority status. And frankly I think it is about time people are hired for their ability despite it not being PC.

I voted for this amendment because I'm tired of seeing my white friends who have 4.0 GPAs and great clinical skills get rejection letters from med schools because they are white and the schools have quotas to be filled (and often with less qualified candidates). My African American cousin actually got refused from nursing school in Virginia because TOO MANY African Americans apply there, and they needed more whites to fill their quotas! I think it's obvious that it is now possible in America to get somewhere by working hard no matter what your race or gender. Just look at our president-elect! I believe that AA was definitely necessary at one point in this country, but we have moved forward. Some bias still exists, of course, but AA is now discriminating against others simply because of their race or gender, and that is not right.

To Stephanie...If you're really set on getting a job as a stocker go to Hy-Vee...the one I worked at 22 years ago employed me (a "girl") as a stocker. In fact there were quite a few of us "girls" who did stocking for that store. Personally, I prefer the job I have now, which I petitioned to take over from a person who could only marginally do it. My hard work has gotten me two raises in three years...25% and 10% respectively. They paid the previous person what was deserved for the work that was done, I do more and am more responsive to our clients, therefore am paid more. And yes, I too have a degree. I do agree with you on one point...racism is racism, no matter who is perpetrating it, just as sexism is sexism, whether it comes from a man or a woman.

Everyone should be appalled about this!I just relocated to Nebraska 2 years ago. Nebraska already has a stigma of being a backwoods and redneck state. This outcome isn't helping that! I just hope that one day we will be able to see past the color of someone's skin and pick the most qualified. The best presidental candidiate won last night and this is progress. However, we still have a long way to go and affirmative action is needed in NE! Personally, this outcome has solidified my decision to relocate and leave NE!!!!

I think many of you are missing the point of affirmative action. It was meant not to give unqualified minorities and women positions, but force employers to seriously consider them. There's a "good ole" boy network out there that has shut out minorities and women out for decades. You guys don't think Obama didn't benefit from AA to get to where he did? Colin Powell has even admitted he's benefited from it. Yes, everyone should be considered on the basis of their qualifications, but that's not the world we live in. I've tried for the fire department several times, always scored in the 90th percentile, not yet accepted. Usually out of 2500 applications or so, maybe 10 are african-americans. Ignorant (notice I didn't say stupid) voters are the only reason 424 passed and was even on the ballot. My wife, who has a master's degree in chemical engineering, had to text a friend to make sure 424 was the banning affirmative action initiative. I'd bet the petitioners who got the signatures to put this on the ballot did not mention affirmative action at all. "Hello, we would like you to sign our petition to add language to the NE state constitution outlawing discrimination based on race, sex, etc, etc" and people went sure, that sounds like a good idea. The ballot initiative was worded the same way. If you didn't know what is was going in, just reading the ballot, you would think, sure that sounds like a positive thing and I'll mark yes. If it would have said "ban affirmative action, yes or no" It wouldn't have passed. I am betting it will go down in flames with the lawsuits that are all ready started on this issue.

You're absolutely correct, Eric. If God had meant for them to be treated equally, they would have been born white. Right? Affirmative action is not legaized racism, it's evening the playing field so everyone has an opportunity to succeed.Be proud, Eric, the white male in Nebraska has once more assured that "old times here are not forgotten". By the way, I'm a white male. This is such an embarrassment for our state.

It seems some people need to repeat elementary school, as some appear not able to read. "A vote FOR will amend the Nebraska Constitution to prohibit the State, any public institution of higher education, political subdivision or government institution from discriminating against, or granting preferential treatment to, individuals or groups based upon race, sex, color, ethnicity, or national origin in operating public employment, education, or contracting." I fail to find the confusing wording. Maybe we should man the polls with kindergarten teachers to explain the "bad wording" on the ballots for those who don't understand.

Yes, the wording was confusing- but that is why I researched it PRIOR to voting. You have access to this web page- you know you can also find sample ballots on the internet? Oh- and there is even websites devoted to 424, both for and against! Shocking! Do your homework people! And for what it is worth, Im a married female with 2 girls. I work (as well as my husband) we are not even the slightest bit privileged and I voted FOR 424. Ive never had a problem getting management positions because I was qualified! If your not as qualified you shouldn't get the job based on your minority- that is not equal treatment.

To those who thought the wording was "confusing" what part of the English language do you not understand? The wording was simple, concise and plain as day. I know you will come back with some sort of excuse to justify your errors but the fact remains that you simply did not take the time or effort to read what was in front of you. To Stephanie: With that line of thinking, I would strongly suggest you get a refund on that college education of yours.

wow steph, i do feel for you on your issue. There are solutions to those problems, get a new job. No one is forcing you to stay at your current job and if a Bag-N-Save wants to hire males to stock shelves, so be it. It is their business they should not have to follow BIG GOV'T policies. Gov't is too involved in issues in today's society. If a business doesn't want to hire a certain employee, they should not be forced to by the gov't. It doesn't mean they can change and hire girls to stock shelves, they just won't be forced to by this policy. NE isn't the only state to vote this down, CA, OR, WA also did. Also, if an issue is confusing on the ballot, don't vote on it, it's better to leave it blank than not know what the heck your voting for. Too bad Obama bin Laden won. I don't think there was a good candidate this election, but NOBAMA was definitely the worse of the two. We'll see how long it is before all the blue kool aid drinkers will be switching to red.

I am also a female yet I believe that even though affirmative action was put into place for a good reason, it is no longer needed. Personally, I do not want to get a job based on my sex or race. I want it because I earned it. It's no wonder certain people can't succeed with the attitude that without affirmative action, minorities or females won't succed in society. Where is the belief that you can succeed because of your talents not because you are a certain race or gender?

If the wording on the ballot was confusing, the perhaps you could have taken some time to get a sample ballot and have someone read it to you. Perhaps without afermitive action those who could not read and understand the wording will no longer get into colleges ahead of someone more qualified.

It's not the 1960s anymore. At one time AA had its needed place. Now it does not. Fill positions based on qualificiation, not to fill a quota.

I always thought Affirmative Action was suppose to help us girls and it didn't. We still don't get equal pay for equal work and it caused too many bad feelings when we were told the reason we didn't get a job was because they had to have so many of these and so many of those for the government count. So it really never helped anyway.

I am sorry Eric, there is no such thing as reverse racism... It is all racism... White vs Brown, Brown vs White... Racism all the same! And I am guessing you are white males Rich, Eric, and Lee! Because obviously you have never had to work 10 times harder than your male counterpart in order to get a pay raise of equal value! It doesn't even matter that affirmative action is there... I work in a company where I have a male counter part who is lazy as sin and doesn't do their job... I work my rear off and make a lot less than they do and we started 1 month apart. Also, I get less payraises than he does! You tell me how fair that is... Also, you try to get a job at Bag-N-Save and have the manager tell you that you can't have a stocking job because they don't hire girls for that job! So please tell me that not having affirmative action is a good thing... It just proves that you are the white privileged! And just for your knowledge I am a white girl with a college education!

I think its about time that a job goes to the more qualified person rather than someone that is less qualified. Being a veteran and seeing women or minorities promoted to higher rank just for that reason.

I think it's really ridiculous to say that women and minorities cannot succeed in today's society without affirmative action. Affirmative action is essentially reverse racism, and it gives every racist in the work place an excuse to think that their black coworker doesn't deserve their job. I understand things are not equal in this country, but affirmative action is causing more divides than it is solving.

Affirmative Action is just another form of legalized racism and needs to be abolished nationally. If a person does not meet a minimum requirement then the requirement should not be bent specifically to to ensure they get the job because of their race, sex, ethnicity or national origin.

I think the wording on the ballot was confusing and if you didn't know what they were trying to do with that amendment, people didn't understand that a vote "yes" is a damaging, detrimental thing and women and minorities alike will not be able to exceed in society without this because even though we have elected a minority president, we are not as forward on equality as all may think!
