WOWT 6 News has learned who will be part of a 3-judge panel to decide whether Nikko Jenkins will get the death penalty.
A panel is required in Nebraska whenever the death penalty is a possibility. Jenkins has been convicted of killing four people in the summer of 2013. Douglas County District Court Judge Peter Bataillon, who proceeded over the case, will be on the panel.
Joining Bataillon will be Judge Paul Merritt, Junior who has been a judge in Lancaster County in Lincoln since the late 1980’s and Judge Mark Johnson who comes from the Norfolk area. Johnson became a judge in 2013.
At this point, it’s a matter of coordinating their schedules. It’s expected that they will hear the Jenkins case in late July or early August at the Douglas County Courthouse.
The other judges were selected by the Nebraska Supreme Court based on a random draw from all eligible District Court judges.
