School Mergers Stand

The U.S. Supreme Court has rejected an appeal regarding a state law requiring Nebraska's smallest schools to merge with larger districts.

Former Nebraska Attorney General Don Stenberg had filed an appeal on behalf of the schools, asking the nation's highest court to block the law. He argued that requiring the elementary only districts to merge with larger, K-through-12 districts by June 15th was unconstitutional.

The Nebraska Supreme Court ruled earlier this year that a judge was wrong to put on hold a state law that calls for the mergers.

Opponents mounted a successful petition drive to put the question of repealing the law on the November ballot. However, the merger law remains in effect.
