Nebraska Department of Correctional Services (NDCS) Director Mike Kenney announced Tuesday three inmates released early due to a miscalculation of sentence time have been arrested.
Carlos McDaniel and Justin Wallace are in the custody of NDCS. Jerry Lopez is in custody in the Douglas County Corrections facing additional felony charges.
“I want to thank our partners in law enforcement for their work in bringing these individuals back into our custody,” said Kenney. “They did an outstanding job of keeping public safety and officer safety at the forefront of this issue.”
According to online prison records, McDaniel was serving time for Possession of a Deadly Weapon by a Prohibited Person before his early release. Wallace, a convicted robber, was serving time on the same charge. Lopez was also serving time for that charge and First Degree Assault.
Earlier this month, NDCS released a complete and detailed description of circumstances regarding the inmates that were released early due to miscalculations of sentences. There were 20 arrest warrants issued at that time.
From those who owe time, one final individual, who was in custody in another state, is currently at large. The name of the individual is being withheld due to law enforcement and public safety concerns.
An all-points bulletin (APB) has been issued nationwide and Gov. Heineman will seek extradition once the individual is in custody. The individual’s name will be released at that time.
