The proposed Indian-owned casino in Carter Lake is again under fire, this time from its own state. The Pottawattamie County Board of Supervisors will decide Monday if it will join Nebraska's lawsuit ordering a halt to construction of the casino or file a separate suit.

Nebraska's argument is since Carter Lake, Iowa is on the Nebraska side of the Missouri River, the no gambling law should take effect.

Iowa officials are worried that the Ponca Tribe won't be required to pay state gambling taxes.

pro indian guy, if indians are living here like they should, why do they need special privileges? Are they better than the rest of us, because their ancestors lived here longer? Giving them special privileges now is racist. It proves we live in a heritage based caste society, just like India!

I feel its really sad that Nebraska is sticking there nose in where it doesnt belong, after all it is Carter Lake and not Omaha. Whats the difference of the Casino being in Council Bluffs or Carter Lake, there both Iowa. If Nebraska is sick of Iowa getting all the money then build one in Nebraska, why stop Carter Lake from developing!

At least the Indians speak english and live like they should here unlike all the illegal Mexicans that are here. I would much rather see the Indians get a casino built then all the illegal non-english speaking Mexicans that are living on our county

"Let's do it for the indians!" How many Omaha Poncas are there? I've searched and found wildly varying numbers. And where is the Omaha Ponca reservation? I mean, how long will these impoverished indians have to commute to work in Carter Lake?

Somehow I just knew the anti-smoker and anti-fahey lobbies would throw their worthless whining into this argument too. And of course this is about the money! 99.9% of everything these days is about money. From child custody to auto accidents to stadiums to Indians. Ever wonder what would happen if people thought about what was best for everyone involved instead of just money? Perhaps a compromise? Naw, lets just throw it into the courts and waste a few more tax dollars instead of using our brains. No tj, it is no longer America: land of the free. Now it is America: home of the self-centered lawsuit lovin' whiner. What do you get from a society that thinks every child is a winner and "time out" is the best way to discipline children? Thats right, adults that are.. (say it with me)... self-centered lawsuit lovin' whiners.

To DAVE...are your comments always so ingnorant? People go to these places KNOWING there will be 2nd hand smoke...I'm a non-smoker so if I don't want to deal with it, I go elsewhere..give it a rest already! To the government...for heavens sakes let them build...I know why Pott Co. is fighting it, which is a spineless act to keep all the extra bucks in their pocket, this is a good opportunity to provide much need revenue in their area as well as jobs, education etc....why do you feel you can monopolize the casino industry? What spineless cowards!! USA Land of the Free???????

Iowa has its own problems at this point. As far as the point that Dave made earlier about smoking in the casinos, that is a far cry off the beaten path. We are talking about the Ponca tribe wanting to build a casino in Carter Lake. I understand smoking in a casino may not be pretty but look. If people are willing to spend their hard earned money to gamble that is up to them. If they want to go gamble elsewhere such as Carter Lake, Iowa, it should be up to them. Cigarette smoke is a separate issue. Do me and everyone else a favor.....QUIT GRIPING ABOUT IT!!!!

It is none of Nebraska's business what they do in Iowa - whether it is on their side of the river or not - it is still Iowa. I think the other casinos in CB are against it because it will hurt their business.

By allowing Indian tribes to run casinos, we've given them the right to drive a portion of Americans into poverty, just as the US government did to many Indian tribes. The only difference is, those going into poverty today do it willingly, if not by addiction. Do two wrongs make a right?

Adding another casino to the mix might elimanate jobs not create them to the other casino's. Without gaming taxes it doesn't do either Iowa or Nebraska any good. Last year was the first year that the casino's did not increase revenue and actually casino's might be on the decline.

Federal Indian Gaming Laws, hmmmmmmmmmm. Ask the legal departments and powers that be if they have even read them. Ask them what are the benefits of the Native ran organizations. I bet they do not know or have even reached their conclutions on intelligent reasoning. That is to say, looking at all sides of an argument. With the gambling across the river will this open Nebraska into a racial discrimination lawsuit? What are Federal laws concerning Cities, Counties, States in interference into American Indian Lands? For more information look at the Marshall Trilogy decisions (Supreme Court rulings) If gambling is wrong, why have the State ran lotteries. Is it just wrong for the American Indian? I suspect there is more to all this than meets the eye.

JW, where did you get your law degree? From a gumball machine? Nebraska has plenty of interest in what goes on in Iowa. What if Iowa started dumping toxic waste in the Missouri? (Note the subtle comparison to gambling.) What if a bunch of Iowans worked in Omaha without paying taxes in Nebraska? What if people from Nebraska were registering their cars in Iowa to avoid higher fees in Nebraska? These things could happen, and Nebraska has an interest.

I think the american indian has had enough taken from them, they deserve to be able to build this casino, If their land hadnt been taken from them in the first place they wouldnt be stuck on reservations with nothing to look forward to,thats probably why they have a problem with alcoholism,they do not complain much at all. let them build it.

Wasn't it the US government that agreed to give special privilages to Native Americans? Suck it up Iowa and Nebraska - let the government keep at least one promise to the Natives. The Native community could certainly use all of its revenue to help its own people who use or abuse our 'system'.

Maybe Iowa should worry about the gamblers they are killing with second hand allowing smoking in the casinos. Oh wait those casinos pay taxes and this one may not..Shows where Iowa really stands.

I don't see a basis for their lawsuit, unless it has to do with a loss of revenue because people closer to Carter Lake then Council Bluffs will not go over there.

Well, if Pott. County wants to sue the tribe to not get the casino, they're better off doing it separate from Nebraska, because Nebraska has no jurisdiction over anything that happens in Iowa. However, Pott. County also has NO authority as far as Native lands are concerned, so.... It's really lose-lose for the county so they should just let it be. Besides, the idea of a casino for the Ponca tribe will not only bring in revenue for the tribe (who are probably still waiting for their beef and blankets), but provide needed jobs for a large number of tribal members.
