The state is fighting to reinstate felony charges against a Pleasant Dale man implicated in the death of his 10-month-old daughter.

Felony charges against Lucas Peterson were dropped earlier this year by Seward County District Court Judge Alan Gless. Gless says investigators last year told Peterson he would not face felonies if he told them were they could find his daughter, Trista.

Peterson then led police to his daughter's body, buried in a shallow grave.

Gless suppressed evidence in the case, citing police mistakes that included pushing Peterson into making involuntary statements.

On Tuesday, an assistant attorney general argued to a Nebraska Court of Appeals judge that the evidence should not be suppressed.

Why would the judge do that. This is why beyond a vicious crime he murdered the little girl and than buried her. He should get the death chair for that

This is just another case of the police being in a hurry to close a case and get a confession. NO PROMISE SHOULD of been made to this "person" Plea agreements like this are a injustice to the victim. He killed her and she was only ten months old. He doesn't deserve to get off. Reinstate the charges and the individual who made the agreement with him needs their head checked. We waste to much money protecting the "rights" of the offender and not the "rights" of the victim.

Thats right--poor guy--was pushed into making statements such as where he buried the body of an innocent baby girl. Where are the rights for the baby?? We spend far too much time protecting the guilty.

This man, who kills his infant daughter, doesn't think that he should be charged with a felony? News Flash! I always thought that murder was a felony. If a person can stoop so low, as to kill an innocent child, he needs to pay the consequences. Get life in prison, and on the childs birthday, and the anniversary of her death, he should be put in solitary confinement just so he doesn't forget.

Rules are rules. Prosecutors should stick their heads in a bag and fight for air instead for messing up this entire investigation.

Who cares if police promise not to press charges (felony or not), as long as the person is guilty, THEY SHOULD BE CHARGE!!! This "man" (and I use that word lightly) is a sickening excuse for a human being, and I'd LOVE to knock that smirk off his face!

Whats the problem? He did it, he murdered that beautiful little girl, buried her for the animals to find, and then he showed the police the grave. Throw him in prison and let the inmates have their way with him! They inmates LOVE people that have killed children!!!!!!!!!
