    Four arrested at downtown hotel in theft investigation

    What started as a theft investigation ended with a Douglas County Sheriff's deputy shooting a suspect Wednesday morning at a downtown Omaha hotel. Four people were taken into custody.

    It happened at the downtown Marriott Courtyard at 10th and Dodge.

    Sheriff Tim Dunning says the case began with an investigation of a purse that was stolen. A credit card was among the items in that purse and used by a suspect to pay for a room.

    "They had rented the room at the Courtyard Marriott and the hotel staff became suspicious that they were possibly using someone else's identity,” says Sheriff Dunning. “They called the people whose identification was being used and they stated that they had not, that they had a theft from their vehicle."

    Two sheriff's deputies, Mike Smith and Brenda Wheeler, went to the fourth floor room around 10:15 a.m. "The deputies found that a male and female were leaving the room as they approached it the deputies inquired as to why they were using someone else's credit card to rent the room," says Dunning. "There was a scuffle in the hallway that made its way into the apartment."

    During the scuffle, a .22 caliber loaded gun fell out of a pair of rolled up jeans the suspect was carrying.

    The man then hit Deputy Smith in the back of the head with a vase, leaving a four-inch gash. "He got a pretty good laceration on the back of his head," says Dunning.

    Smith then shot 32-year-old Jason Galle once in the chest. Galle also suffered a broken leg during the struggle with Deputy Smith. Galle was taken to Creighton University Medical Center with serious injuries, but the sheriff said later his condition had stabilized.

    A woman who was with Galle, 23-year-old Dana McCoy, was also taken to the hospital as a precaution because she's pregnant. She was later charged with possession with intent to deliver methamphetamine and two counts of felony theft.

    "It's very unfortunate that the deputy had to go through that, but I think he handled himself professionally and according to his training and the suspect can be thankful that he's not dead," says Dunning.

    "Jason Galle has a pretty extensive criminal record. In fact for sure some charges will be fugitive of justice from the state of Iowa and from the state of Nebraska."

    A criminal record that might soon also include charges of ID theft, not only for Galle, but also McCoy. "We know there are other IDs being used because the ID the female had given Deputy Wheeler and that ID, we're not even sure who that person is yet."

    Both deputies are on administrative leave while the investigation into the shooting continues. Smith has been in the department at least 10 years. Sheriff Dunning says Wheeler has been there 16 or 17 years.

    Neither one was armed with a Taser, but coincidentally Smith had just completed a gun training course that addressed when to use deadly force.

    A trail of credit card purchases led deputies to the hotel. The cards came from a purse that had been stolen Sunday from a car parked outside St. Wenceslaus Catholic Church at 153rd and Pacific. The owner's cell phone, cash, garage door opener and identification were also in the purse.

    "Deputies were alerted to the Courtyard Marriott because it was suspected that the ID was being used to rent a room that was not being used by the owner of that credit card," says Dunning. "This was just a routine follow-up investigation that turned into a shooting."

    "I'm having a good feeling about the fact that I think we've probably broken up a ring of identity theft." The reason Sheriff Dunning mentioned an ID theft ring is that when they found suspects Galle and McCoy in the hotel, they were actually on their way to another room where 37-year-old Eldrid Dightman and 22-year-old Daniel Luichinger were with a copy machine and other ID-making materials.

    Both were charged with felony possession of methamphetamine and felony illegal use of a credit card.

    OC, he might be hinting at the fact that certain demographic groups instantly assume that the police are always 100% at fault in any deadly force incident, and that the criminal never is at fault (and were a good kid that was just turning their life around etc etc). This would also be the same demographic group that rarely saw any crime happening, even if it went on under their noses.

    Please if you are involved with meth and id theft you may put yourself in a position to be shot by police especaiily if you hit them in the head. Kudos to the police on this one

    mTm- I don't know how to read your comment. Are you surprised their is no outrage because you think there should be? Striking an officer in the head with an object is a deadly force attack. If an officer does not react to defend themselves they could lose consciousness and then a suspect could take their gun and kill them, or continue to beat them to death or whatever. Luckily the cop wasn't knocked out after the first hit so he could respond. Simple punches can turn in to a deadly force situation. If a suspect get the upper hand and is on top of an officer and is repeatedly punching the officer in the face and head, it is perfectly justified for the officer to respond with deadly force if they believe that not doing so could lead to their death or serious bodily injury.

    HE IS LUCKY HE WAS ONLY SHOT ONCE. IT'S PAR FOR THE COURSE THAT THE UNMARRIED, YOUNG, DRUG ADDICTED, CREDIT CARD STEALING, NO-JOB HAVING, DRAIN ON SOCIETY WAS PREGNANT. WE WILL BE PAYING FOR HER ENTIRE FAMILY....FOREVER.

    To "s" the officers involved were detectives. They are typically dressed in suits. Though they carry a gun and handcuffs, they more than likely not carrying a taser. After all they went to investigate. The bad guys chose to fight. It's sad he was shot and I'm sure the officer isn't jumping for joy that he had to shoot someone, but I know I and his family are thankful that he returned home safely. He protected himself and his partner. I'm glad we have officers like this protecting us. The sad thing is this guy will get some attorney who will have the gall to waste our money and have a trial. He's guilty as sin and we all know it. Safe the money and lock him up.

    Sara for you to say something about being shot is policy custody... he was not yet in police custody.... read my dear.... he was only questioned at this time... Let us also remember that he gave force to the officers first and I am glad the officers are able to go home... whatever the exspense is. RESPECT them and they wont have to show force..DONT break the law you wont have these situations...I do agree with the comment about if they were another race, the race card would be used.... Do the crime do the time....

    Good JOB for the Law enforcement on this one. The scumbags got what they deserve.. The guy that got shot, he is lucky to survive it. He got what is long overdue and deserved. To Sara: What is the police officer to do??!!! Treat these drug crazed, unpredictable criminals with kid gloves? The Officer was justified in shooting him. More scumbags and criminals off the streets! It is sad about the female suspect. She will be having her bay while she is serving time, at taxpayers expense. It will more than likely be a Meth baby. How sad. I hope they all get some lengthy jail time.THUG, PUNK Drug pushing scumbags that do not know how to make an honest living and steal and rip off innocent people, it will always catch up with them sooner or later.     Sorry...no outrage for a supsect who was justifiably shot by the police. He had a weapon and was resisting arrest, what did he and the public expect to happen. Either way, this man commited a criminal act. He can't honestly have a expected a postive outcome.

    I think some of you may be confusing "policy custody" with just being in the presence of a police officer. If Mr. Galle was "in custody" that would mean he was handcuffed and controlled. The fact that Mr. Galle was shot 'after' he hit an officer in the head with a vase would indicate (to me) that he was not in "custody" yet. It's too bad someone got shot, but it's even worse that an officer of the law got injured while trying to put these thugs "in custody". I rather doubt that the gun that fell out of the rolled up jeans was going to be used for any 'good purpose'. If the gun wouldn't have fallen, there is a strong possibility that one or more of the officers could have been shot by Mr. Galle. Good work to the Marriott employee who alerted police to these people. Maybe if more people would follow the example and start being proactive to crime then crime might actually go down in our fair city. That way there's no reason to 'cry' about excessive force by the OPD. Clean up crime!!!

    I think the point of comments made about the new stadium and the trolley is that this city thinks NOTHING of wasting money on the "extras" in life, but we don't have a contract with either the city or the fire unions, we've had record numbers of retirements from both forces, and the Federal sewer mandate has not been addressed in 20 years. And of course the ongoing pothole/infrastructure problem. I think THAT'S the point...I've always said Omaha needs to address the ESSENTIALS before any "extras" (as should any city)and Fahey & Co seem unwilling to do it. In fact, the pension "spike" plan was Fahey's deal anyway, so he needs to address the contracts and replacing members of those forces before ANYTHING "entertainment-related" should be undertaken. But that's just my take on it.

    Did you people read the whole story before you made your comments? The suspect made the first move by starting the fight with the officer. The suspect dropped a gun out of a pair of jeans. The officer was struck on the head all of this happened before the officer shot him. Gee, I don't know, what would you do if you were in that officer's shoes at that time? I myself would have done exactly what he did, pull my weapon and defend myself. What do you people want? I want someone that can take care of me and himself if I am ever in danger. What was he suppose to do ask Galle what he was going to do with that gun when he dropped it? I think not. God bless the officer involved and I wish him a speedy recovery.

    I guess I am a bit confused...a lady leaves her purse in her car AT CHURCH. The dirtbags steal it...and her identity. Now they are hanging out in the hotel room which they stole using other peoples money and with a loaded gun. When they are confronted he hits the deputy. Why would you question the police here? Collectively, the man and woman have a variety of charges related to theft and drugs. I am glad that they are off the streets, at least for now. I wish the deputy a quick recovery and thank both deputies for a job well done!

    mTm and Sara: There isn't outrage because the shooting was perfectly justified, and yes it is concerning that more people are shot in police custody, but it's not the police getting more violent, it's the suspects. You want him to wait and see if the man gets charged with assault on an officer before he fires his weapon? Lets see you try to survive that.

Maybe you should be more concerned with real issues i.e. the lack of mental health facilities in this community rather than a stupid baseball stadium..or do you believe the horrific westroads incident was a result of the new baseball stadium?

    Why isn't anyone saying "They didn't have to shoot him. Why couldn't they just use a taser?" Could it be because the suspect is white? If he were black, the officers would be called trigger happy racists. Think about it. Note the difference in past postings where the suspect has been black compared to this one. To all of those who complain of excessive force only when it is a black suspect, how is this any different? weapon resisting arrest = officer involved shooting. It doesn't matter if you're black or white.

    Congrats are in order to the police for catching these thieves but I think a pat on the back is due to the employee's of the Marriott for being alert and doing a super job. Had they not reported it, the thieves would still be there doing their evil little tasks. Great job Marriott employees!

    I hope the suspect in the hospital does us taxpayers a favor and keels over. The St Wenceslaus parking lot has been hit before; I don't understand why women think their purse is safer in the car there than with them in church. Why bring it along at all if you're leaving it in the car? Unfortunately, the plate collection might have to pay for some private patrol.

Also, if you are using a stolen credit card, and you don't expect to get caught, YOU ARE THE EPITOME OF STUPID! Why would they rent a hotel room in Omaha on a Tuesday night?     Your correct, This town is full of Idiots. Thanks crimefighters for getting two more pieces of crap off the street. The stadium has nothing to do with the crime rate. These freaks are out in mass doing this everyday. The upbringing and lack of parental supervision is whats led to the lack of respect for authority. It would take years to reinstall honor, integrity and a solid work ethic into todays society. But in the meantime as a law abiding citizen who does the right thing, I am damn proud of the mayor for accomplishing a historic contract with the NCAA and moving this city forward. May all the lowlifes rob and shoot each other into oblivion, the sooner the better because they won't be at the new stadium with me enjoying good kids playing sports!!

    The crime rate in this city is NOT directly proportional to the building of the new stadium. You people are idiots! Stop using the stadium as a catalyst for your uneducated unfounded comments. It only makes it appear stupidity runs rampant in this city as well. If you had any common sense you would know that you can go to any hotel/motel in town and find all kinds of illegal activity. And none of it has anything to do w/ trolleys or ballparks. God Bless Stupid!

    these comments are ridiculous. What in the world does have to do with a stadium that hasn't even broken ground. Rather than have any soultions, I guess some people in our "heartland" will find anything to complain about. tougher laws, which are made by lawyers, more jails, that no one wants to pay for? We will never be crime free. I hope the deputy is doing ok, it's part of his job though.

    DUMMIES!/friends of the devil. Let me guess: The suspects had lived in poverty so much they just HAD to take advantage of a stolen credit card to live it up. Rooms at Hotels are usually over-priced space. Expensive beds/TV & shower. Material things are over-rated. Cars, etc. cost too much! Love not the world neither the things in the world. The present earthy or earthly things PALE in comparison to what is going to be. That is, if you don't get a wild hair & do illegal things. It starts with NOT being `content. Granted, there are disparities in the amount of riches that people have squirreled away & the way they got it & share it but to resist the Police when they are trying to enforce the law even on your behalf? The Police would have helped the perpetrators if they had something stolen from them. The one guy didn't have the civility to co-operate & take his medicine. He's going to get a very different kind of medicine now- Pain! Live by example. Care & share! Watch & pray! Repent!
