Couple pleaded no contest to misdemeanor charges for a disturbance at Eagle Raceway last summer.
Roger and Theresa Brindley, both age 35, had each previously faced Class IIIA Felony counts for a scuffle in the stands with a 13-year-old girl but accepted the plea arrangement in Cass County District Court. The judge found them each guilty of third degree assault and set sentencing for May 14th.
The Cassgram reports Deputy Cass County Attorney Steve Sunde said the Brindleys were seated a few rows in front of the then 13-year-old when an argument over race car drivers began. Theresa Brindley threw a beer in the face of the girl and struck her; Roger Brindley also struck the girl, leaving a welt on her forehead, said Sunde.
Sunde said there are varying accounts of the incident from the parties involved but a neutral witness would have testified the Brindleys left their seats and went up to confront the girl.
The mother of the girl was also involved and pled guilty to disturbing the peace as part of a plea agreement in Cass County Court.
