Fact Finders: Tree Dispute


EMERSON, Iowa A tree crashes into a home, but who is at fault remains in the air.

Tim Fort, a mobile home owner in Emerson, Iowa, claims a tree that fell onto his home is owned by the city. The city's Mayor doesn't see it the same way.

"Everything from the sidewalk on it ours," said Mayor Rob Erickson. "There's not sidewalk here. So that's why I'm saying it's pretty touch-and-go as to whether or not this is really our tree."

Despite the Mayor's words, he told WOWT 6 News Face Finders that he will go to bat for Fort. Erickson said he will talk to the town council and the city's insurance carrier, but until the red tape can be unraveled Fort is left living at his daughter's home 50 miles away.

"I want to be compensated for my trailer," said Fort.

A spokesperson for Red Cross said they're going to contact Fort to assess his needs. The Mills County emergency manager told WOWT 6 News that he'll be looking into the situation too. The replacement of Fort's trailer, however, will be a dispute to be settled between Fort and the city of Emerson.
