A family has to move out of their house for their own good. For months they lived in a rented house without knowing its history.
The scraped off sign hints the house near 41st and Miami in Omaha had been condemned, but Matt Davis moved his wife and son in about a year ago after the landlord assured him repairs had been made. “I trusted him, trusted that everything was good to go.”
Though saying he recently sold the house, landlord Henry Lou sent a text that it should be up to code. That was news to city code enforcement. “You have someone moving into a situation that's unsafe and unfit and the potential for something happening is there,” said Kevin Denker with the city code enforcement office.
A city inspector told Davis to move his family and he can see why, right through the hole in the floor next to the tub. Lou said Davis was working for him and paid rent of $400 a month, but repeatedly told Fact Finders the house had been fixed up before the family moved in.
“And finding out the house has been on the demo list since before we moved in,” said Davis.
After more than a year, the city still has a demolition order on the house and inspectors will remind the now former owner. “Him moving the tenant in, we would look at citing him,” said Denker.
Though finding a place and money to move within days won't be easy, Davis plans to sue his former landlord who he condemns for renting the house. “Yeah, very lucky.”
The city and tenants say Lou recently sold the house to his mother. She'll be put on notice that the house can't be occupied unless brought up to code and passed by city inspectors.
